“No fragmentation or amalgamation of any site or building shall be permitted.

Chandigarh, 17th July 2018: In exercise of the powers conferred by Section 3 and 22 of the Capital of Punjab (Development and Regulation) Act, 1952 as adapted by the Punjab Re-organization (Chandigarh) adaptation of Laws (on State and Concurrent Subjects) Order, 1968 and all other powers enabling him in this behalf, the Administrator, Union Territory of Chandigarh is please to amend Rule 16 of Chandigarh Estate Rules, 2007 as under:-

  1. These rules may be called the Chandigarh Estate (Amendment) Rules,
  2. These rules shall come into force from the date of publication in the Chandigarh Administration Gazette.
  3. In the Chandigarh Estate Rules, 2007, for Rule 16, the following shall be substituted:-

“No fragmentation or amalgamation of any site or building shall be permitted.

[Provided that the amalgamation of two or more adjoining sites with the same ownership shall be permissible only in the case of commercial, industrial and residential sites subject to the condition that the revised plans are approved by the Competent Authority prior thereto. However, the said amalgamation in respect residential sites will not be applicable to the EWS Category, residential plots/units of Chandigarh Housing Board and other rehabilitation Schemes for affordable housing under special schemes of Govt. of India and the Chandigarh Administration.]

Provided further that the fragmentation of any site shall be allowed if such fragmentation is permitted under any Scheme notified by the Administration.”
